On 24 June 2026, the EU General Court annulled<\/a> the European Commission\u2019s exclusion of aircraft manufactured for private or commercial business aviation from the EU Taxonomy\u2019s \u201ctransitional\u201d activities. The case was brought by Dassault Aviation, maker of Falcon business jets, after the Commission\u2019s 2023 delegated regulation kept business aircraft manufacturing outside the sustainable finance framework.<\/p>\n The ruling is narrower than some headlines suggest. It concerns aircraft manufacturing and access to sustainable finance, not the operation of individual charter flights. It does not make a private jet journey \u201cgreen\u201d, and it does not change UK charter rules. If you charter a private aircraft<\/a> from the UK, the practical focus remains the same: aircraft choice, routing, fuel, load factor and credible emissions reporting.<\/p>\n The General Court found that the Commission\u2019s reasoning was flawed. The Commission had relied partly on carbon dioxide emissions per passenger kilometre, comparing business aircraft with other transport modes. The court said that measure relates to how aircraft are operated, not how they are manufactured, so it was not a proper basis for excluding a manufacturing activity.<\/p>\n The court also said the Commission had failed to consider relevant factors, including the ability of these aircraft to operate on sustainable aviation fuel. It recognised that business aircraft have specific characteristics, including flexibility, speed and connectivity, and that other transport modes are not always genuine low-carbon alternatives for every mission.<\/p>\n That point matters in real aviation use. Business aircraft are not only used for executive travel. Similar aircraft can support urgent medical movements, organ transport teams, repatriation and medevac and air ambulance services<\/a>, where timing and direct access are critical.<\/p>\n The ruling does not relabel every business aviation activity as sustainable. It simply reopens how business aircraft manufacturing may be assessed under the EU Taxonomy. The Commission can still appeal to the Court of Justice on points of law within 2 months and 10 days of notification.<\/p>\n The UK is outside the EU Taxonomy. In July 2025, the government confirmed it would not build its own<\/a> UK Green Taxonomy, choosing instead to focus on sustainability reporting, transition planning and other disclosure tools.<\/p>\nWhat the court actually decided<\/h2>\n
